1. Acceptance of terms
By accessing or using FormWell Digital's website or platform (the "Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of a company, you represent that you have authority to bind that company to these terms.
2. Description of service
FormWell Digital provides real-time property listing tracking, homeowner contact enrichment, and mail-ready lead export tools for moving companies, delivered through a web-based dashboard scoped to each customer's assigned markets and zip codes.
3. Accounts
Accounts are provisioned for business customers and their authorized users. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use.
4. Acceptable use
You agree to use the Service only for lawful business purposes consistent with its intended use as a lead-generation tool for moving companies. You will not attempt to access data outside your assigned territories, resell or redistribute data obtained through the Service outside the scope of your agreement with us, or use the Service in a way that violates applicable law, including laws governing direct mail marketing and consumer data.
5. Data accuracy
Listing and homeowner data is sourced from public records and third-party data providers and is provided "as is." While we work to keep this data current, we do not guarantee its completeness or accuracy, and you should exercise independent judgment before relying on it for business decisions.
6. Payment
Fees for the Service are set out in your order form or agreement with us. Fees are billed on the schedule agreed at signup and are non-refundable except as required by law or expressly stated in your agreement.
7. Intellectual property
The Service, including its software, design, and underlying technology, is owned by FormWell Digital. These terms do not grant you any rights to our trademarks, logos, or branding.
8. Termination
Either party may terminate an account as set out in the applicable order form or agreement. We may suspend or terminate access to the Service if these terms are violated.
9. Limitation of liability
To the fullest extent permitted by law, FormWell Digital is not liable for indirect, incidental, or consequential damages arising from use of the Service, including damages arising from inaccuracies in third-party listing or homeowner data.
10. Governing law
These terms are governed by the laws of the State of Texas, without regard to its conflict of law principles.
11. Changes to these terms
We may update these terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the Service after changes take effect constitutes acceptance of the revised terms.
